PENALTY

Report:

David King advised Mr Aldersea that he had been reported of a Level 2 Offence (Threatening or intimidating towards an umpire, official or player including verbal abuse). David King asked Mr Aldersea if he pleaded Guilty or Not Guilty of this offence. Mr Aldersea advised that he was "Technically Guilty" of this.

Tribunal notes:

Umpire Peter Bennett read his statement of events. The Umpire advised that he heard Mr Aldersea threaten Justin Varney of EFCC. Mr Aldersea advised that Mr Varney had been abusing Phoenix players throughout the 2nd day of the match. At the point this escalated, Mr Varney is alleged to have abused Mr Aldersea. Mr Aldersea then responded to Mr Varney by saying to him "What are you going to do about it?". Mr Varney then lunged at Mr Aldersea, grabbing his neck and pushing him. Phoenix expressed that they didn't believe Mr Aldersea should be suspended.

Penalty:

The Panel discussed these matters and found that Mr Aldersea was Guilty of the Level 2 Offence (Threatening or intimidating towards an umpire, official or player including verbal abuse). The penalty given was 6 playing dates, the minimum for the Level 2 offence. In addition to this, a $100.00 fine was issued to Phoenix. Phoenix and Mr Aldersea were advised that they could appeal the findings of the P&D under by-law 67, should they so wish, within 24 hours of this hearing.
